1. Introduction
1.1 Purpose
KRYLIA Content Protection Services ("KRYLIA", "we", "our") respects copyright and other intellectual property rights. This DMCA Policy outlines how we handle takedown requests and counter-notices under the US Digital Millennium Copyright Act (DMCA).
2. Our Role
2.1 Service Provider and Enforcement Agent
KRYLIA scans for unauthorized redistribution of user content and submits takedown notices on behalf of our users. We act as both a service provider hosting creator accounts and an enforcement agent submitting notices to third-party platforms.
3. Submitting a DMCA Takedown Request
3.1 Eligibility
Only the copyright owner or their authorized representative may submit a takedown request through KRYLIA.
3.2 Required Information
A valid DMCA notice must include:
- Identification of the copyrighted work claimed to be infringed
- The URL or location of the infringing content
- Contact information of the rights holder
- A statement of good faith belief that the use is not authorized
- A statement that the information is accurate and, under penalty of perjury, that you are authorized to act
- Signature of the rights holder (electronic signature accepted)
3.3 Submission
DMCA notices should be sent to legal@krylia.app. KRYLIA will review, validate, and forward notices to the relevant platforms.
4. Counter-Notice Procedure
4.1 Filing a Counter-Notice
An alleged infringer may submit a counter-notice if they believe content was wrongly removed or that they have the right to use the content.
4.2 Requirements
A valid counter-notice must include:
- Identification of the removed content and its location prior to removal
- A statement under penalty of perjury that the content was removed in error or misidentification
- Full contact information and consent to jurisdiction of the relevant court
- Signature of the counter-notifying party
5. Repeat Infringer Policy
Accounts associated with repeated copyright infringement may be suspended or permanently terminated from the KRYLIA platform.
6. Limitation of Liability
6.1 No Guarantee of Removal
KRYLIA takes action to enforce DMCA notices but cannot guarantee removal of infringing content from third-party platforms.
6.2 Third-Party Compliance
Third-party platforms may choose not to comply fully with DMCA notices. KRYLIA is not liable for content that remains online after good-faith enforcement efforts.
